Terms and Conditions of Use

1. Acceptance of Terms

By downloading, registering, or using the STRUKTTO platform, you voluntarily and expressly agree to be bound by these Terms and Conditions of Use. If you do not agree with any clause described herein, you must refrain from using the application.

2. Account Registration and Security

To access the system, the user must complete the registration by providing true and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials (whether email/password or Google login) and for all commercial or operational activities conducted under your profile.

3. Subscription Plans and System Limitations

STRUKTTO offers three service tiers with the following features and operational constraints:

• Basic Plan (Free): Allows management of up to 1 active project at a time, 3 workfronts, storage of up to 3 APUs, a Flow schedule limited to 50 activities, and a maximum of 5 workers visible in the payroll.
• PRO Plan: Supports up to 5 active projects simultaneously, 10 active workfronts per project, unlimited APU creation, unlimited Flow schedule (up to 5,000 activities), an extended portfolio in the business directory with up to 20 photos, priority support via WhatsApp in less than 1 hour, and a PRO Verification Badge in search results.
• PRO IA Plan: Unlocks unlimited active projects, 20 active workfronts per project, and unlimited access to advanced Artificial Intelligence functions (AI Auditor and AI-powered APU Generator).

4. Free Trial Queries for Artificial Intelligence (AI)

To allow users to experience the benefits of the AI Auditor before upgrading their subscription:

• The PRO Plan includes a maximum of three (3) free trial queries for the AI Auditor in total.
• The Basic Plan (Free) includes a maximum of one (1) free trial query for the AI Auditor in total.

Once the corresponding free trial queries are consumed, access to the interactive AI Auditor will be locked automatically until the PRO IA plan is purchased.

5. Rules of Proper Use and AI Query Confinement

To ensure data security and avoid excessive resource consumption:

• Technical Confinement: The AI Auditor tool is strictly confined to answering queries and analyzing schedule data, progress, contractors, and workfronts of the selected project. The AI will automatically refuse off-topic questions (e.g., general culture, software programming, translation, creative writing), responding with a predefined standard refusal message.
• Daily Safety Limit: To prevent abuse and guarantee system stability, AI Auditor queries are limited to a strict maximum of twenty (20) queries per day per user.

6. Material Images in the Marketplace

Images of supplies and materials uploaded by suppliers to the STRUKTTO Marketplace are intended solely and exclusively for the sale, quoting, and promotion of their products within the platform ecosystem:

• Strict Use Policy: Suppliers, builders, and third parties are expressly prohibited from using these images outside of STRUKTTO, downloading them for external marketing campaigns, or performing any unauthorized commercial use or external advertising without express written consent.
• Copyright Responsibility: The ownership of copyrights, accuracy, and licenses of the uploaded images lies strictly with the supplier who uploads the material. STRUKTTO assumes no liability for third-party intellectual property claims related to the supplier's visual catalog.

7. Marketplace and Mandate Contract

When making purchase transactions in the Marketplace, STRUKTTO acts under the legal figure of a Mandate Contract to facilitate connection, ordering, and collection of payments. Product quality, delivery timelines, suitability, and product warranties are the sole responsibility of the selected Supplier.

8. BIM Models and Data Storage

The platform includes an interactive BIM viewer (IFC). In order to optimize server storage, STRUKTTO applies a consolidation policy that may overwrite previous versions of uploaded models. It is the user's responsibility to keep backups of their original design files.

9. Intellectual Property

All source code, Flow planner logic, BIM viewer, AI auditing algorithms, and the STRUKTTO brand are the exclusive intellectual property of the company. The user is granted a limited, non-exclusive, and revocable license to use the platform for operational and construction management purposes.

10. Limitation of Liability

STRUKTTO is a technology platform to assist in project management. Real-world structural success, regulatory compliance, and physical safety of the construction site remain the sole responsibility of the builder, resident engineer, and the professionals in charge.

11. User-Generated Content and Moderation

STRUKTTO maintains a zero-tolerance policy regarding objectionable content or abusive behavior. It is strictly prohibited to upload material containing nudity, violence, harassment, spam, or illicit activities. All user-generated content can be reported using the built-in tools in the app. STRUKTTO reserves the right to review reports and immediately remove any violating content, as well as suspend or terminate the responsible user's access without prior notice, in compliance with app store regulations.
